Yellowstone Pasta Company Privacy Policy

Welcome to Yellowstone Pasta Company!  Here at Yellowstone Pasta Company, we aim to provide you exceptional handmade and handcut Montana pasta.  Whether you consider yourself a pasta connoisseur or are new to the pasta world, we look forward to sharing our delicious pasta with you.

We operate our website (https://yellowstonepasta.com, or any successor or replacement website, the “Site”) to provide you with information about our pasta, including recipes and preparation tips, and allow you to establish an account and place an order for our monthly pasta subscription service (the “Subscription Service”).  We don’t sell your personal information.  When we collect personal information about you through our Site, we use that information to improve your experience and our services, contact you about our programs and activities, answer your questions, trouble-shoot problems, and fulfill your orders.  You can find more information about what types of personal information we collect and what we do with it in this policy.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it.  If you do not agree with our policies and practices, your choice is not to use our Site or the Subscription Service.  We update this policy from time to time, so you should check back regularly for updates.  Your continued use of this Site after we make changes is deemed to be agreement to and acceptance of those changes, so please check the policy periodically for updates.

This policy does not apply to information collected by us offline (when you interact with our employees in person or over the phone) and it does not apply to websites we do not own or control, even if we have provided a link to that website for your information or use.

Although most of our visitors call Montana home, we know that our customers come from all over the world.  Without conceding that we have a legal obligation to comply with the laws of your home country or state, we want you to know that we are committed to protecting your information.  If you have a question or concern about what we have covered in this policy, feel free to give us a call!  We will do our best to address whatever concerns you may have.

Categories of Personal Data

For purposes of this policy, “personal data” means any information that is linked or reasonably linkable to an identified or an identifiable individual.  Different states and countries use different definitions of “personal data” or “personal information.”  Because we call Montana home, we use the definition in Montana’s Consumer Data Privacy Act.  Common examples of personal data include your name and address, email address, registration and contact information, billing and payment information, and data about the device you are using to access our website or services.  The personal data we collect depends on the extent of your interactions with our products and services, the features you use, and applicable law.  The categories of personal data we collect can include the following:

Individual Identifiers.  Identifiers such as your name, mailing address, unique personal identifier or user name, internet protocol (IP) address, email address, phone number, date of birth, and other similar identifiers.  We use this information to register you for an account, which you will need to place an order for our Subscription Service.

Credentials.  Customer codes, passwords, password hints, and similar security information used for authentication and guest account access.

Account History.  Information about the services we have linked to your account, including your order history, mailing addresses, and account status.

Credit Card and Payment History.  Data to process payments, such as your credit card and authorization information, and information about the activities associated with your account.

Usage Data.  Data generated by your activity on our Site, including the following:

  • Interactions.  Data about your interactions with the Site, including the time and date of your visit, the amount of time you spend on each platform, the webpages you view, and your use of any of the features or services we offer (including those provided by our third-party vendors and partners)
  • Devices and Configuration Data.  Data about your device and your device configuration, such as the domain name of your Internet Service provider, the IP address assigned to the computer you are using to access the Internet, the name and version of your web browser, and your computer’s operating system and platform.
  • Error Reports and Performance Data.  Data concerning the performance of our Site, including any problems or errors you may experience.
  • Surveys and Requests for Information.  Data submitted by you in connection with a customer survey or request for information through our Site, including specific topics of interest (such as financial advice, estate planning, etc.), your geographic location, your email address and other contact information, your company’s name and website, and any additional information you may choose to include in an unstructured message to us.

Internet or Other Electronic Network Activity Information.  Data collected through the use of cookies, tags, tracking pixels, or similar technology about your browsing history, search history, and interactions with our websites and advertisements.  These technologies are saved by your computer and will recognize your device in the future.  If you return to the site that placed the cookie, it can remember you from your last visit and keep track of your activity over time.  Cookies collect information about the pages you view and your activities on our website, help us keep track of your preferences, customize your browsing experience, and deliver specific ads or offers to you.  You can find out more about cookies here: https://allaboutcookies.org/what-is-a-cookie

Retail Sales

Our online store is hosted by Shopify, an e-commerce platform that includes a range of tools for selling across web, mobile, social media, and online marketplaces, managing products, inventory, payments, fulfillment, shipping, and engaging customers through marketing, advertising, and communications.  Shopify routinely collects personal information about visitors to storefronts like ours through the use of cookies, a small amount of information that is downloaded to your computer or device when you visit certain websites.  Shopify uses a number of different cookies to collect information about your activities on their hosted sites, including functional cookies used to remember choices you have made or information you have provided (like your username, language, or geographic region) and analytics or reporting cookies to collect information about how often you have visited certain sites and what you did while you were there.  You can see a full list of the functional and analytics cookies placed by Shopify on our storefront here: https://www.shopify.com/legal/cookies.

Platform-Specific Data Collection

Yellowstone Pasta Company operates two integrated platforms:

  • Website Content & Forms: Our main website, yellowstonepasta.com. We control and manage all content, forms, and analytics on this site. Any personal information you submit through contact forms, newsletter sign-ups, or surveys is collected and processed directly by Yellowstone Pasta Company and our trusted service providers.
  • Online Store & Checkout: Our ecommerce storefront is hosted by Shopify, which handles product listings, subscriptions, payments, and order fulfillment. When you make a purchase or subscribe to our pasta box service, your personal and payment information is collected by Shopify and processed according to their Privacy Policy and Cookie Policy.

We do not control how Shopify’s cookies function or how Shopify uses your data beyond what is necessary to fulfill your order. For details on Shopify’s data practices, please refer to their legal documentation.

Payment Accounts

To maximize the number of payment options available for our guests, we have enrolled in multiple payment programs, including Shopify Payments, Google Pay, PayPal, and Venmo.  These payment options will appear as an accelerated checkout option on our checkout page.  If you wish to make purchases using one of these options, you will need to sign up for that service separately, with the payment provider who owns the service (Shopify, Google, PayPal, and/or Venmo).  Your use of these payment options is subject to the terms of your agreement with each provider.  We do not control how these payment options function, the terms of use associated with your use of these services, or the payment provider’s use of your personal information.

Our Newsletter and Promotional Communications

You can sign up to receive our newsletter and other promotional communications from us through our Site.  When you provide your name and email address, we will add you to our distribution list and you may receive emails from us concerning the newsletter, our products, future promotions and discounts, and special offers.  You are not required to sign up for our newsletter to use our Site or participate in our Subscription Service and you can cancel at any time.  If you ask us to remove you from our distribution list, we will do so promptly upon receipt of your request.

Surveys & Contests
From time-to-time, we may request information from you via surveys, contests, or other promotions. Participation in these surveys or contests is completely voluntary and users may choose whether or not to participate and therefore disclose this information. Information requested may include contact information (such as name and shipping address), and demographic information (such as zip code, age level). Contact information may be used to notify the winners and award prizes.

 Linked Sites

Our Site may contain plug-ins and other features that integrate third-party social media platforms, like Facebook, Instagram, X, and YouTube.  You can activate these plug-ins manually by clicking on the icons located on our homepage.  If you do so, the collection and use of your personal data is subject to each company’s privacy policies.  We have no control over the collection and use of your information by Meta (Facebook and Instagram) or X, should you elect to leave our homepage and visit their sites.

For your convenience, hyperlinks may be posted on our Site that link to external websites we do not control.  We are not responsible for, and this policy does not apply to, the privacy practices of other company.  You should not assume that our policy applies to any external sites, or that the policies applicable to those sites are similar to ours.  You will need to review each site’s privacy policy to understand how your personal data will be collected and used by the owner of the site.

Your Privacy Rights and Options

Consumer Rights Requests.  Yellowstone Pasta Company is based in the State of Montana.  We value your confidence and trust in us and take the privacy of your information extremely seriously.  If you have a question or concern about this privacy policy and our use of personal information, please feel free to contact us!  Even if the law in Montana is different from your home jurisdiction, we will still do our best to resolve any requests you may have.

If you would like to access, correct, delete or obtain a copy of your personal data, please contact us at the email address below.  Remember to include “Privacy Rights Request” in the subject of your email, so we can get it to the right people.  Once we have received your request, the first thing we will do is determine if we have collected and retained any of your personal data.  If we are in possession of your personal data, we will confirm receipt of your request and contact you to verify your identity.  The method by which we will verify your identity may vary, depending on the type and sensitivity of your personal data, the risk of harm to you, and the technology available to you.  If we cannot verify your identity with reasonable certainty, we will deny your request and inform you that your identity could not be verified.  Although you are under no obligation to cooperate with our efforts to verify your identity, we cannot act on your request until you have done so.

Please do not send us any sensitive personal information as part of your request.  Should we require any information beyond your name and account number, we will contact you to discuss a secure and reliable means of transmitting that information to us.

Our resolution of your request will depend on the nature of the personal data and the purposes of our processing of your data.  We reserve the right to decline your request if we are unable to authenticate your identity, if we have a good faith, reasonable, and documented belief that your request is fraudulent, or if your request exceeds what is required of us under applicable law.  We may elect to fulfill your request without conceding the applicability of any legal requirement that would require us to do so.

Should we decline your request, you may submit an appeal of our decision to the following email address: yellowstonepasta@gmail.com.  Please include “Consumer Privacy Appeal” in the subject of your email.

Browser-Based Controls.  Your browser may include certain features that will assist you in controlling the collection and use of your personal information.  These features may include:

  • Cookie Controls.  Your internet browser will enable you to select to receive or block cookies under various conditions.  However, should you choose to decline or block cookies by adjusting your browser settings, you may disrupt the operation of cookies that are essential to our Site.  You can typically block cookies through the browser’s “Settings” or “Preferences” menus.  You can find more specific instructions on your browser’s support site or here: https://allaboutcookies.org/what-is-a-cookie (under “How to disable third-party cookies”).
  • Browser Controls for “Do Not Track.”  Some browsers have incorporated “Do Not Track” features that can send a signal to websites you visit indicating that you do not wish to be tracked.  Because there is not yet a common understanding of how to treat these signals, you should use the “Do Not Track” feature in conjunction with another form of opt-out.  Many websites still collect and use your browsing data to improve security, provide content, services, ads and recommendations on their websites, and generate reporting statistics.

NAI Interest-Based Advertising.  The Network Advertising Initiative (NAI) offers consumers the option of opt-ing out of interest-based advertising by participating NAI member companies.  You can use the service to find out which participating NAI member companies may be conducting interest-based advertising on your browser, learn more about their privacy practices, and choose to opt-out of interest-based advertising from one, some or all participating NAI member companies on your browser.  You can access NAI’s opt-out page here: https://optout.networkadvertising.org/?c=1.

DAA Interest-Based Advertising. The Digital Advertising Alliance (DAA) offers a similar opt-out that applies to use of interest-based advertising and web-viewing data by DAA’s participating companies.  You can learn about the privacy practices of participating companies and register your preferences here: https://optout.aboutads.info/?c=2&lang=EN.

Newsletter and Promotional Communications.  You may unsubscribe from our marketing communications by contacting us at the email address below or clicking on the “unsubscribe” link located at the bottom of our emails.

Children’s Privacy

Our Site contains information about our home-made pasta, including recipes and preparation tips.  This information is not intended for use by children without supervision, and in no case, by any child under the age of 13.  If we learn that we have collected or received personal information from a child under the age of 13 who has visited our Site without verification or parental consent, we will delete that information.

Our Subscription Service is not intended for anyone under the age of 18.  If you are under the age of 18, do not register for an account or provide us with your personal information.  If we learn we have collected or received personal information from a minor under the age of 18 without verification or parental consent, we will delete that information, including any associated account or payment information.  Use of our Subscription Service by anyone who is considered a minor in the jurisdiction in which they reside is a violation of our Subscription Terms, which you may review here: https://yellowstonepasta.com/terms-and-conditions/

Changes to Our Privacy Policy

We strive to be as open and transparent about our data collection and processing as possible.  As our Site and the associated products and services evolve, we will make updates to this policy.  When we post changes to the policy, we will post the date of the latest update at the top.  If there are material changes to the policy, such as a change to the processing of your personal data that is not consistent with the purpose for which it was originally collected, we will notify you by either (i) posting a prominent notice of such changes to our Site before they take effect; or (ii) by sending you a direct notification, via email or your last contact address on file.

We encourage you to periodically review this policy for updates and contact us if you have any questions or concerns.  All changes will become effective when posted.
